TERMS AND CONDITIONS

  1. Entry into the MOMO-001 Raffle (“the Raffle”) is subject to these Terms and Conditions. Participation in the Raffle is deemed to be acceptance of these Terms and Conditions.
  2. By accepting these Terms and Conditions, all entrants acknowledge that they have carefully read and agree to enter into a Future Astronaut Agreement (“SXC Agreement”) with Space Expedition Corporation of Jacob Obrechtplein 3 1071 KS Amsterdam The Netherlands (“Activity Organiser”). Click here for a copy of the SXC Agreement. Click here for a copy of the SXC Trip Cancellation Agreement. Click here for a copy of the XCOR Informed Consent Liability Waiver Agreement. All third party Agreements referred to above are annexed to this website in their most recent format but are subject to change at the discretion of the Activity Organiser and their suppliers. The Mission Massimo Foundation will not be liable for any such changes.  Should the Prize Winner fail to comply with these Terms and Conditions and/or the SXC Agreement, they will forfeit the Prize, without rights to any refund or compensation.
  3. The Raffle commences at 8:00am Australian Eastern Standard Time (AEST) Sunday 1st September 2013 and ends at 5:00pm AEST on Friday 29 August 2014 (“the Raffle Period”).
  4. Raffle entry is open to residents of any country whose laws allow entry into a raffle of this nature. Entrants must be 18 years of age at the time of signing the SXC Agreement. If an entrant is under 18 years of age at the time of entry, the entrant must have parental/guardian approval to purchase a ticket and further, the parent/guardian of the entrant must read and accept these Terms and Conditions. Parents/guardians may be required by the Mission Massimo Foundation to enter into a further agreement as evidence of consent to the minor entering this raffle.
  5. To enter, entrants must go to www.missionmassimo.com (“the Website”) during the Raffle Period and follow the links to the MOMO-001 Raffle and fully complete their details on the online entry. Incomplete entries are invalid.
  6. There is no limit to the number of raffle tickets (“tickets”) an entrant may purchase, until otherwise notified by the Promoter. A single ticket is AU$1,000, or a purchaser may purchase 5 tickets for AU$5,000 and receive the 6th ticket free or a purchaser may purchase 10 tickets for AU$10,000 and receive the 11th, 12th and 13th tickets free.
  7. Payment for tickets may be made online by credit card via a secure payment portal. The Promoter reserves the right to refuse payment via certain methods and/or accept fundraising credits in lieu of payment. Tickets will only be issued and no refunds will be granted once payment has been processed. The price of tickets is expressed as exclusive of GST. Tickets do not constitute a tax invoice and the ticket price is not tax deductible under Australian law.
  8. It is the responsibility of the entrant to enter a correct, valid address and to check this address for delivery of ticket(s). A physical ticket will be delivered by mail and a facsimile of the ticket will be sent via email. The Promoter is not liable for non-delivery of ticket(s) to the entrant, howsoever caused.
  9. The Prize is a reservation for a Future Astronaut suborbital flight on an X-COR Lynx MK II (“Space Flight”) and includes two nights’ accommodation at a luxury hotel (selected at the sole discretion of Activity Organiser) on location, which is anticipated to be the United States, medical checks and training gear. Neither the Promoter nor the Activity Organiser can guarantee the exact date of the Space Flight and by entering the Raffle, the entrant acknowledges that the Prize is a reservation for a future event.
  10. Any costs associated with the taking up of the Prize, including but not limited to travel to and from the Space Flight location, spending money, meals, taxes, insurance, passports, visas, vaccinations, transfers, items of a personal nature, in-room charges and all other ancillary costs are not included in the Prize.
  11. The Raffle will be drawn (“Prize Draw”) at the head office of Mission Massimo Foundation at 24 Villiers Street Elsternwick 3185, Victoria, Australia at 5pm AEST on Sunday, 31st August 2014. The winner of the Prize (“Prize Winner”) will be decided by a barrel draw. The result is final and no other correspondence will be entered into, except to facilitate delivery of the Prize.
  12. The total value of the Prize is approximately AU$110,000 (US$100,000).
  13. The Prize Winner will be notified by phone and email within two (2) days of the Prize Draw and by mail within seven (7) days of the Prize Draw. Their names will also published in The Australian Newspaper on Saturday, 6 September 2014 and on the Website for a maximum period of three (3) months from the Prize Draw, after which time they will be removed. If the Promoter is unable to contact the Prize Winner, the Prize Winner has three (3) months to claim the Prize by contacting the Promoter, otherwise the Prize Winner forfeits the Prize.
  14. The Promoter will contact the Prize Winner in relation to delivery of the Prize and reserves the right to request the Prize Winner provide proof of age, identity and residency upon delivery. Identification considered suitable for verification is at the discretion of the Promoter. The Promoter reserves the right to conduct security verification checks at its absolute discretion. The Prize Winner may be required to sign a declaration confirming their eligibility to accept the Prize.
  15. The Prize may not be exchanged for another product or cash. The Prize Winner may transfer the Prize to another person who agrees to enter into the SXC Agreement. Should the Prize Winner, or transferee, fail any medical check required to take the Space Flight the Prize may be transferred subject to additional charges paid directly to the Activity Organiser as specified in the SXC Agreement. The prize can only be transferred and may not be on sold under any circumstance.
  16. Entry is not available to employees or executive board members of the Promoter or relatives of any such employees or executive board members, meaning any of the following: spouse, de-facto spouse, parent, child or sibling (whether of full or half blood).
  17. In the event of any dispute regarding the conduct of this Raffle, the decision of the Promoter is final and no correspondence will be entered into.
  18. If the Raffle is not capable of being conducted as reasonably anticipated due to any circumstances beyond the control of the Promoter, the Promoter reserves the right in its sole discretion and to the fullest extent permitted by law to modify, suspend or cancel the Raffle as appropriate, subject to the requirements of any regulatory authority.
  19. The Promoter is not responsible for the scheduling or operation of the Space Flight, which is the sole responsibility of the Activity Organiser. It is the sole responsibility of the Prize Winner to ensure s/he complies with the SXC Agreement and all requirements of the Activity Organiser.
  20. To the fullest extent permitted by law, the Promoter (including its committee, executive members, officers, employees and agents) shall not be liable (including for negligence) for any loss, damage or personal injury whatsoever which is suffered or sustained (including but not limited to indirect or consequential loss) as a result of (a) any technical difficulties or equipment malfunction (whether or not under the Promoter’s control); (b) any theft, unauthorised access or third party interference; (c) any entry or prize claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter; (d) any variation in prize value to that stated in these Terms and Conditions; (e) any cancellation or delay of the Space Flight or any reason beyond the reasonable control of the Promoter; (f) any tax liability incurred by any Prize winner or entrant; (g) use of prize; (h) failure to take the Prize; (i) failure to satisfy the requirements of the Activity Organiser as set out in the SXC Agreement; or (j) the conduct of this Raffle.
  21. If the Prize Winner forfeits the Prize for any reason, the Promoter reserves the right (upon receipt of approval from all government authorities if required) to sell the Prize, the proceeds of which sale will be paid to the Mission Massimo Foundation to be used for not for profit purposes.
  22. The Promoter collects personal information in order to conduct the Raffle and may, for this purpose, disclose such information to third parties, including but not limited to the Activity Organiser and as required to Australian regulatory authorities. Prize claims are conditional upon the entrant providing this information. The Promoter may for an indefinite period use the information for promotional, marketing and publicity purposes, including sending electronic messages and telephoning the entrant. Entrants may opt out of receiving marketing material from the Promoter by ticking the appropriate box on the online entry. Entrants may direct any request to access, update or correct personal information to the Promoter. All entries become the property of the Promoter.
  23. The Prize Winner may be required to participate in publicity arising from this Raffle, including (without limitation) the filming of their participation, local Australian activities organised by the Promoter and the Space Flight together with the dissemination of such materials in any media channel throughout the world. Entrants consent to the Promoter using their name, likeness, image and/or voice in the event they are the Prize Winner (including photograph, film and/or recording of the same) in any media for an unlimited period without remuneration for the purpose of promoting this promotion (including any outcome), and promoting any products manufactured, distributed and/or supplied by the Promoter.
  24. The laws of Australia apply to this Raffle and the entrant submits to the exclusive jurisdiction of the courts of Australia.
  25. The “Promoter” is the Mission Massimo Foundation (ABN 21 931 625 405) located at Mission Control 24 Villiers Street, Elsternwick 3185 Victoria AUSTRALIA. All proceeds of the Raffle go to the Mission Massimo Foundation.
